GIFT CARDS POLICY
Effective Date: January 1, 2022
The following terms and conditions (the "Gift Card Terms") govern the purchase and utilization of Rhaika LLC Gift Cards ("Gift Cards"). Your purchase and usage of the Gift Cards imply your acceptance and adherence to these Gift Card Terms.
1. Purchase, Redemption & Use
Gift Cards are valued in U.S. dollars and are available for purchase at Rhaika LLC stores or online at RhaikaStore.com. Coupons, promotions, and discounts cannot be used for Gift Card purchases. Gift Cards cannot be returned, applied as payment to any account, or used to purchase additional Gift Cards. They are non-transferable, non-reloadable, and non-saleable. Gift Cards cannot be exchanged for cash, except where required by law. They are not valid for international orders.
2. Balance Inquiry
To check your Gift Card balance or obtain information about Gift Cards, please visit your account on RhaikaStore.com.
3. Expiration & Fees
The portion of your RhaikaStore.com account balance comprised of purchased Gift Cards or credit issued to compensate for purchased merchandise does not expire* and may be used for eligible purchases on RhaikaStore.com. We do not impose any dormancy, inactivity, or service fees related to the non-use of purchased merchandise credit or Gift Cards.
4. Lost, Damaged, or Stolen Cards & Fraud
Lost, stolen, or damaged Gift Cards will not be replaced. Rhaika LLC is not liable for any unauthorized use of your Gift Card. The purchaser assumes title and risk of loss upon sale. Please treat your Gift Card as you would cash and safeguard it accordingly. Rhaika LLC reserves the right to refuse Gift Cards suspected or believed to be obtained or used fraudulently or unlawfully.
5. Limitation of Liability
GIFT CARDS ARE PROVIDED "AS IS," AND Rhaika LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Rhaika LLC AND ITS AFFILIATES MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCESSIBILITY OR ACCEPTANCE OF GIFT CARDS. Rhaika LLC AND ITS AFFILIATES AND VENDORS SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE, INJURY, CLAIM, OR LIABILITY BASED ON OR RESULTING FROM GIFT CARDS OR THEIR USE. IF Rhaika LLC IS LIABLE TO YOU, YOUR SOLE REMEDY WILL BE TO RECOVER ACTUAL AND DIRECT DAMAGES NOT EXCEEDING THE LAST BALANCE HELD ON YOUR GIFT CARD. CERTAIN PROVISIONS OF THIS PARAGRAPH MAY NOT APPLY TO CONSUMERS IN THE STATE OF CALIFORNIA OR IN OTHER JURISDICTIONS WHERE PROHIBITED BY LAW.
6. Dispute Resolution & Applicable Law
If our Customer Service team cannot resolve your concern, any disputes arising from your purchase or use of Gift Cards or these Gift Card Terms will be resolved through binding individual arbitration, instead of in court. You may also file individual claims in small claims court if they qualify. The Federal Arbitration Act and federal arbitration law apply.
Note: Arbitration does not involve a judge or jury, and there is no class action. An arbitrator can award the same damages and relief as a court, including injunctive and declaratory relief or statutory damages, and must adhere to these Gift Card Terms.
To initiate arbitration, send a letter describing your claim to Att: RHAIKA LLC, 30 N Gould St, Sheridan Wyoming 82801, United States. with a copy to info@rhaikastore.com. The arbitration will be conducted by the American Arbitration Association ('AAA'). AAA's rules govern the payment of filing, administration, and arbitrator fees. Arbitration may be conducted by telephone, based on written submissions, or in person in Sheridan, Wyoming, or another mutually agreed location.
We agree to arbitrate disputes individually, not as part of a class, consolidated, representative, or collective action. If a claim proceeds in court instead of arbitration, both parties waive the right to a jury trial or to participate in a class action against the other. However, both parties may sue in court to stop intellectual property infringement or other misuse.
THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN CLASS OR REPRESENTATIVE CLAIMS, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. ADDITIONAL RIGHTS THAT YOU OR RHAIKA LLC MAY HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION.
7. Applicable Law
These Gift Card Terms are governed by and construed in accordance with the laws of the State of Wyoming and the United States of America, without applying any conflict of law provisions.
For disputes not handled by arbitration, you agree to file any action arising from these Gift Card Terms only in state and federal courts located in Sheridan, Wyoming. You irrevocably and unconditionally consent to the exclusive jurisdiction of such courts over any suit, action, or proceeding arising from these Gift Card Terms.
8. General Terms
We reserve the right to modify these Gift Card Terms at any time, providing notice of changes as required by law. If any condition is deemed invalid, void, or unenforceable, that condition will be considered severable and will not affect the validity and enforceability of the remaining conditions.
